The woman, who has not been publicly identified because she is a possible sexual assault victim, said Cuban sexually penetrated her with his finger at a Portland, Oregon, bar after she asked to take a photo with him in April 2011, according to the Portland-based Willamette Week, which recently obtained a copy of the incident report.

Meanwhile, Cuban "repeatedly and adamantly denied" the woman's allegations during a voluntary recorded interview with a Portland police detective, according to the memo.

He also voluntarily passed a polygraph test, according to the report.

"I filed the report because what he did was wrong", she said.

Cuban spoke to police directly following the report being filed. "I stand behind that report 1,000%".

Portland defense attorney Stephen Houze, who represented Cuban during the police investigation, sent the same message Wednesday morning in an email to The Oregonian/OregonLive.

"This incident never happened and her accusations are false".




On Feb. 20, Sports Illustrated published the findings of a lengthy investigation that uncovered a pattern of misogyny and predatory sexual misconduct within the Dallas Mavericks organization.

Yet a friend of the woman also reportedly told officers that Cuban was "very drunk ... his eyes were half closed, he was unstable on his feet, and he was slurring his words". They were described by an officer as showing Cuban, whose hands were not visible, appearing to "be stretching to reach his arm down" while standing beside the woman. "Cuban and no one observed any inappropriate behavior by Mr. Cuban".

"She will not participate in a criminal prosecution and agrees her claim can not be proven", the memo reads.

Later, Cuban lamented the he-said/she-said nature of the allegations. "In this case have you lied to your attorney in any way?"

Cuban continues to deny the incident.

Explaining their decision in a report, prosecutors wrote that "there is no evidence to corroborate the complainant's statement and there is evidence contradicting the claim", and that the woman chose not to proceed with her claim.
