Louisiana Attorney General Jeff Landry is expected to announce his decision about potential state criminal charges against two police officers in the Alton Sterling case.
According to Louisiana Attorney General Jeff Landry, the officer's fatal actions were deemed "well-founded and reasonable".
Landry's office announced the decision Tuesday (March 27) after first notifying Sterling's relatives in person.
State investigators received the case in May 2017 after the U.S. Department of Justice announced it would not be pursuing civil rights charges against the officers, reports CBS affiliate WAFB. Just before the shooting, one of those officers yelled that Sterling had a gun.
"With respect to the second series of shots ... experts emphasized that officers are trained to eliminate a threat", the Justice Department wrote, "and that Sterling appeared to pose a threat because he was still moving and his right hand was not visible to Officer Salamoni".
Citing a toxicology report, Landry also said Sterling had illegal drugs in his system at the time of the confrontation.
Racial tensions were still simmering in Louisiana's capital when Gavin Long, a 29-year-old black military veteran from Kansas City, Missouri, ambushed police officers near a vehicle wash on July 17, 2016.
Officer Blane Salamoni shot and killed Sterling during a struggle outside a Baton Rouge convenience store where the 37-year-old black man was selling homemade CDs.
Landry said their investigation determined that the officers tried to conduct a "lawful arrest" of Sterling. The decision brings another closely watched and widely scrutinized investigation of potential police misconduct to an end without charges.
Landry said the state could not proceed with a prosecution of either officer involved based on an extensive review of evidence gathered by federal authorities as well as his office's own investigation.
If you need a refresher, Sterling was shot outside a convenience store in June of 2016.
"It hurts, though, to see them get away and go on with their lives", Dunn said.
The 26-page lawsuit alleges that Salamoni and Lake breached protocol, used excessive force and violated Sterling's constitutional guarantees against unreasonable searches and seizures and of due process.
Lawyers say Louisiana's attorney general is set to meet with relatives of a black man who was shot and killed in 2016 by a white police officer and inform them whether his office will charge either of the two officers involved in the struggle. When he did not, a struggle ensued with Salamoni pulling out his gun and pointing it at Sterling's head and later Lake attempting to shoot Sterling with a Taser.
