Months after CCI (Competition Commission of India) charged $21 Mn (INR 136 Cr) fine on Google for conducting unfair business practices in India for online search, the global search giant has now filed an appeal in the National Company Law Appellate Tribunal (NCLAT) against the order. It found Google favoring its own shopping service, and demoting rival services in search results.

The penalty is said to be 5% of the total revenue generated by the company from its operations in India via different segments and was imposed on the basis of complaints filed by companies such as Matrimony.com and Consumer Unity and Trust Society (CUTS) against Google LLC, Google India Pvt.

The appeal was filed on Monday.

Early February, the Competition Commission of India (CCI) fined Google for abuse of power and now the tech giant is fighting back by filing an appeal against the CCI's judgement.

Google, the core unit of USA firm (GOOGL.O), did not immediately respond to a Reuters request for comment.

While the CCI had favoured Google in nine out of twelve counts, the watchdog ruled that the company had abused its dominance in search rankings before 2010, had prioritised its Google Flights service over other aggregators and had asked publishers to exclude its competitors in its agreements with them.

In India, watchdog found that Google, via the design of its search, had put its own search functions for commercial flights in a prominent position within the results page from the search, which was a disadvantage to all the businesses attempting to gain an additional piece of the market.

"This order is significant as the CCI recognises that Google is the gatekeeper to the internet and has a special responsibility to ensure a level playing field", he said.

Since Google has appealed the judgement, it could be until sometime in 2018 before the final outcome its determined.

After the February ruling, Google had referred to the issues raised by the Commission as "narrow concerns".

The stance taken by CCI was similar to that of European Commission, which imposed a record fine of 2.4 billion euro (or $3 billion) on the world's popular search engine a year ago.
