Apple Ordered to Pay $502 Million in VirnetX Patent Battle Loss

According to Bloomberg, a federal court in Texas wrapped up the most recent case earlier today, ruling that Apple infringed on VirnetX patents with iMessenger and FaceTime.

VirnetX has been gunning for Apple since 2010 when it filed three lawsuits alleging that its FaceTime, VPN on Demand and iMessage features infringed on owned patents. It's small change for Apple, but an important win for VirnetX.

Apple's stock has seen little change on the news given that the $502.6 million award is minuscule compared to the company's profits. While there will nearly certainly be jubilation at the ruling, Apple has a history of appealing. VirnetX is based in Zephyr Cove, Nevada, and it filed its suit in patent troll-friendly East Texas, a district where patent holders have had a higher chance of success in intellectual property cases until the Supreme Court cracked down on the practice a year ago. Even so, there was still a major difference there, Apple and Samsung both use their patents in products that they make and sell, while VirtnetX focuses on court cases to bring in revenue. Later on, the company was ordered by the district court to pay more than United States dollars 400 million as damages to the patent-holding company VirnetX for copyright violations. This time around, there again reportedly seemed to be no successful streak for the company.




For VirnetX, the jury verdict in its favor could be a short-lived victory.

The Federal Circuit, which handles all patent appeals, declined to put this trial on hold, saying it was so far along that a verdict would come before a final validity decision.
