Peru’s Guerrero Cleared To Play In World Cup After Cocaine Ban

The Swiss Federal Tribunal said in a statement that the 34-year-old would suffer "if he saw himself prevented from participating in a competition that will be the culmination of his career as a footballer, given that he did not act intentionally or with significant negligence".

Peru captain Paolo Guerrero's 14-month ban for testing positive for cocaine has been frozen by a Swiss federal court, allowing him to play in the World Cup.

"Mr Guerrero submitted an urgent request for the suspension of the execution of that sanction in order to participate in the next FIFA World Cup in Russian Federation".

The verdict came four days ahead of Fifa's deadline for Peru to finalize its 23-man World Cup squad.

He could still serve the ban after the conclusion of the tournament.

The CAS will not object to the request for a stay.

The case has attracted widespread attention in the build-up to the tournament, with Guerrero claiming he ingested the banned substance after drinking an aromatic tea made from coca leaves.




That suspension was then halved by Fifa's appeal committee but the World Anti-Doping Agency (Wada) appealed to Cas and, less than two weeks after his six-month ban ended in May, they extended it to 14 months.

Guerrero had the right to a supreme court appeal because CAS is under the jurisdiction of Swiss civil law.

The decision was warmly welcomed by the Peruvian football federation (FPF), which had given Guerrero support in recent months in a bid to get him to Russia for their first World Cup appearance in 36 years.

Thousands of Peruvian fans recently took to the streets to protest the treatment of the forward, who is the nation's top scorer. Since his Peru debut in 2004 he has made 83 global appearances and is the country's all-time record goalscorer with 32 goals.

"WADA was always content to wait for the full reasoned decision from CAS before the player was suspended (as noted in today's SFT decision) and is satisfied that due process is being followed".
